New SBC Regulations – Additional Adjustment Time

As part of the Affordable Care Act’s multiyear implementation timeline, carriers, employers, and plan sponsors would have to begin
distributing standardized SBCs (Summary of Benefits and Coverage) to new hires, special enrollees (status changers) and to any plan participants that requested them beginning March 23, 2012. The Department of Labor published those regulations on August 17, 2011, but left the comment period open until October 21, 2011.

After listening to concerned plan sponsors, however, carriers and employers and have tabled these requirements until final regulations can be issued. Though there will be additional time to comply, carriers, employers, and plan sponsors will still need to work together to gather the medical and prescription drug information (for each plan and each tier) and develop concise, compliant SBCs to be part of future open enrollment processes, be ready to deliver them to new hires and special enrollees, and to any plan participant that requests them.

A new edition of the Compliance Chronicles has been posted in the Compliance Chronicles section of the Crawford Advisors, LLC website. This month’s edition discusses the revised guidance from the Department of Labor regarding the Summary of Benefits and Coverage (SBCs) that plans must distribute to comply with PPACA. The article highlights the challenges the Department of Labor faces in responding to employer, plan sponsors and carriers regarding these SBCs and confirms the Department is delaying implementation.

Summary of Benefits and Coverage: Necessary Action

For calendar year plans, these new requirements do not apply to the 2012 Open Enrollment. However, it will affect your new hires, new enrollees that enroll on/after March 23, 2012. And, if your next plan year begins in/after February 2012, the new requirements must be included in open enrollment materials. Employers with fully insured group health plans should check with their carriers to ascertain whether the carriers will deliver SBCs directly to participants. If not, they will need to make arrangements to prepare and/or distribute the SBCs. Self-insured group health plan sponsors should work closely with their third party administrators and consultants to develop a compliant SBC and develop a delivery strategy as well.
